Terms and Conditions

These Terms and Conditions (“Terms”) govern the mobile foam party services provided
by The Party Genie (“Company,” “we,” “us,” or “our”). By booking or participating
in our services, you (“Client,” “you,” or “your”) agree to these Terms.

1. Services

We provide mobile foam party and photo booth entertainment services, including delivery, setup, operation, and
takedown of foam equipment and/or photo booth equipment at a location designated by the Client (“Services”). Services are
provided on the scheduled date and time agreed upon at booking.

2. Booking and Payment

A non-refundable deposit of 25% required to secure your booking.

The remaining balance is due 3 days prior to the event or date previously agreed upon.

No event is confirmed until payment is received.

Failure to pay the balance may result in cancellation without refund.

3. Event Location Requirements

The Client is responsible for ensuring the event location meets the following requirements:

Adequate space for foam equipment (minimum 10 feet x 10 feet, level ground preferred)

Access to a standard water source within 100 feet

Access to a standard electrical outlet within 100 feet (unless otherwise agreed)

Safe, legal, and permitted use of the property

We reserve the right to refuse or stop services if the location is unsafe or does not meet
requirements. No refunds will be issued in such cases.

4. Supervision and Participant Safety

The Client is responsible for providing adult supervision for all participants, especially minors.

Foam can be slippery; participants enter and play at their own risk.

Running, roughhousing, flips, or unsafe behavior is discouraged.

We are not responsible for injuries caused by misuse of equipment, unsafe behavior, or failure to supervise.

5. Assumption of Risk

You acknowledge that foam parties involve inherent risks, including slips, falls, and minor
injuries. By booking or participating, you voluntarily assume all such risks on behalf of yourself and any participants under your care.

You acknowledge your responsibility for the well-being and functioning of all photo booth equipment once it is dropped off at your location.

6. Health and Allergy Disclaimer

Our foam solution is designed to be nontoxic, hypo allergenic, skin-safe and biodegradable.

Participants with sensitive skin, allergies, asthma, or other medical conditions should consult a
physician before participation.

We are not responsible for allergic reactions or medical issues arising from participation.

7. Weather Policy

Foam parties are weather-dependent.

Events may be postponed or canceled due to unsafe conditions (lightning, high winds, extreme
temperatures, etc.).

Light rain is generally acceptable unless deemed unsafe.

Rescheduling due to weather is subject to availability and must occur within 90 days.

No refunds are guaranteed due to weather unless expressly stated in writing.

8. Client Property and Cleanup

Foam residue dissipates naturally with water and time.

The Client is responsible for any surface conditions affected by foam (grass, pavement,
driveways, decks, etc.).

We are not responsible for damage caused by pre-existing conditions, improper surfaces, or
inadequate drainage.

9. Damage to Equipment

The Client is financially responsible for any damage to our equipment caused by:

Misuse

Intentional acts

Failure to supervise participants

Animals or unauthorized persons

Repair or replacement costs may be charged to the Client.

10. Cancellations and Rescheduling

Cancellations made within 10 days of the event forfeit the deposit.

Same-day cancellations are non-refundable.

Rescheduling requests must be made in writing and are subject to availability.

11. Intellectual Property and Media Release

Unless the Client opts out in writing:

We may photograph or record the event for promotional purposes

All media remains the property of The Party Genie.

No compensation will be provided for use of such media

12. Limitation of Liability

To the maximum extent permitted under New York law:

We shall not be liable for indirect, incidental, or consequential damages.

Our total liability shall not exceed the amount paid for the Services.

We are not responsible for personal injury, property damage, or loss resulting from participation
in the event.

13. Indemnification

You agree to indemnify and hold harmless The Party Genie, its owners, employees, and
contractors from any claims, damages, or expenses arising from:

Participation in the foam party

Breach of these Terms

Failure to supervise participants

14. Independent Contractor

We are an independent contractor. Nothing in these Terms creates a partnership, joint venture,
or employment relationship.

15. Force Majeure

We are not responsible for delays or failures caused by events beyond our reasonable control,
including weather, natural disasters, government actions, or emergencies.

16. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the State of
New York.

17. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in
full force and effect.

18. Entire Agreement

These Terms, together with any booking confirmation or invoice, constitute the entire agreement
between the parties.
